The IEEPA tariff ruling explained
A landmark Supreme Court decision has opened the door to the largest tariff refund in U.S. history. Here is what happened and what it means for importers.
IEEPA Tariffs Imposed
President Trump invoked the International Emergency Economic Powers Act to impose tariffs on imports from China (20%), Canada (25%), and Mexico (25%), citing fentanyl emergency.
Liberation Day Tariffs
Reciprocal tariffs expanded to over 180 countries under IEEPA authority. Rates ranged from 10% baseline to 145% on Chinese goods. Over $166 billion collected.
Supreme Court Rules 6-3
The Supreme Court ruled that using IEEPA to impose tariffs is unconstitutional. IEEPA was designed for financial sanctions, not trade policy. All IEEPA tariffs must be refunded.
CIT Orders Refunds
Judge Eaton of the Court of International Trade ordered CBP to exclude IEEPA tariffs from liquidation and process refunds for all affected entries.
CBP 45-Day Commitment
CBP Executive Director Lord committed to building an automated refund system within 45 days. Judge Eaton modified the order to allow this timeline.
Key Facts at a Glance
What tariffs are covered?
Covered (IEEPA): Fentanyl tariffs on China/Canada/Mexico, Liberation Day reciprocal tariffs, baseline 10% tariffs, all tariffs imposed under Executive Orders citing IEEPA.
Not covered: Section 232 tariffs (steel/aluminum), Section 301 tariffs (China tech), anti-dumping and countervailing duties. These were imposed under different legal authorities.
Important Deadline
Importers with liquidated entries have only 180 days from the liquidation date to file a protest. Missing this window could permanently forfeit your right to a refund.
